SANTA FE – New Mexicans who depend on caregiving services are one step closer to stronger safeguards as the Senate cleared House Bill 131, which enhances background check requirements for caregivers.
“Families place immense trust in caregivers to provide essential support for their loved ones — this public safety legislation ensures we are taking every step to uphold that trust,” said Kari Armijo, secretary of the New Mexico Health Care Authority. “Strengthening background checks reinforces our commitment to safety and well-being for all New Mexicans.”
House Bill 131, now awaiting the governor’s signature, expands the list of disqualifying criminal offenses for caregivers to include:
- Animal cruelty
- Identity theft
- Sex trafficking
- Assault of a peace officer
The bill passed the House with a 48-7 vote and cleared the Senate with unanimous support.
“Safety is a fundamental patient right. This bill strengthens protections for some of our most vulnerable community members,” said Sen. Antoinette Sedillo López, a cosponsor of the bill. “By expanding background checks to include serious offenses like identity theft and human trafficking, we ensure that that caregivers do not have red flags in their backgrounds that could put those cared for at risk. This is crucial for this important work.”
“New Mexicans deserve to know that those caring for their loved ones do not have histories of violence or other behavior that may pose safety risks,” said lead sponsor Rep. Elizabeth Thomson. “As a mother whose son requires full-time care, I know that this legislation will provide much-needed peace of mind and reassurance to families who may already be facing difficult decisions about a loved one’s health and well-being.”
Under HB 131, current caregivers will be subject to the updated caregiver screening requirements. The New Mexico Health Care Authority will oversee enforcement of these measures to support safety and integrity in caregiving services.
