Enforcement Remedies
Child Support Services Division is employed by the public to collect and enforce child support obligations. We understand and sympathize with the financial and emotional challenges faced by split families. Our enforcement remedies are designed to encourage child support collections, as well as cooperation and communication with our field staff. When CSSD has not received complete and timely payments we may:
- Send a letter to the non-custodial party informing them payments have not been received;
- Wage garnishments if non-custodial parties are employed.
- Suspension of driver’s, professional, hunting and fishing, or other licenses;
- Interception state and federal tax refunds;
- Interception of lottery or gaming winnings
- Referral to credit bureaus for arrears
- Bank account and property liens;
- Passport renewal prevention;
- Pursuit of civil contempt through the court and a bench warrant.
- Referral for state or federal criminal prosecution.
CSSD’s goal is to encourage cooperation and compliance with court orders, not to punish non-custodial parties. If you believe the child support obligation is not appropriate, you are welcome to request a modification from your caseworker.
If you are unable to meet your obligation due to a lack of employment, enforcement can be delayed through compliance with our Stepup program. Continued compliance with the program is needed until employment is found.
If action has been taken against you and you wish to dispute it, you have the ability to request an administrative hearing and go before an administrative law judge for review of the action. If you wish to pursue this action, please notify your caseworker, complete the request for administrative hearing request form, and submit it to the office listed on the form.
